General Terms and Conditions for the Organisation of Seminars, Conferences and Courses at ITEL –
Deutsches Lithiuminstitut GmbH (“ITEL”), version dated September 2021

§ 1 Scope

These General Terms and Conditions govern the contractual relationship between Deutsche Lithiuminstitut GmbH, Leipziger Straße 70, 06108 Halle (Saale) (the Institute) and participants in seminars, courses and conferences organised by the Institute (hereinafter referred to as “the event”).

The participant’s terms and conditions shall not apply. By registering, the participant accepts these General Terms and Conditions.

§ 2 Registration

Registration for the Institute’s events must be made in writing or in text form (email, fax, letter) to:

or online via the event website.

Registration must be made by the specified registration deadline at the latest or, if no deadline has been set, two weeks before the start of the event. Late registrations may be accepted provided the Institute can guarantee participation. There is no legal entitlement to this.

§ 3 Conclusion of the Contract

The contract for participation in the event is only concluded upon written confirmation from the Institute to the participant, or via the internet portal provided or commissioned by the Institute for this purpose.
No pre-contractual obligations exist until such confirmation is given. The Institute shall respond to registrations by confirmation or rejection as soon as possible. However, there is no right to a refund within the specified period.

The confirmation of participation applies to the person named in the confirmation. The right to participate may be transferred to another person with the organiser’s consent.

§ 4 Services / Terms of Payment

The participation fee is per person and event date, plus statutory VAT, and covers the services specified in the programme. No refunds will be given for services not fully utilised. The participation fee is due immediately upon receipt of the invoice and must be paid into the account specified on the invoice no later than 4 working days (Mon–Fri) before the start of the event.

§ 5 Cancellation

Participation may be cancelled up to 7 days before the start of the event by the participant notifying the Institute in writing or in text form (email, fax, letter). If a confirmed registration is cancelled up to 7 days before the start of the event, cancellation fees amounting to 50 % of the participation fee will be charged.

In the event of a later cancellation or the participant’s failure to attend the event, the full fee must be paid.

Upon agreement with the Institute, a replacement participant may be nominated at no extra charge.

§ 6 Changes to / Cancellation of the event

The Institute reserves the right to replace announced speakers by others: it also reserves the right to make necessary changes to the event programme whilst preserving the overall nature of the event.
The Institute is entitled, where there are valid reasons, to relocate events to a different venue and/or reschedule them to a different date, or to cancel them.
If it is not possible to hold the event due to force majeure, a speaker being unable to attend, disruptions at the venue, an insufficient number of participants or any other reason, the Institute will inform participants immediately.

In such cases, the participation fee will be refunded. Any claim for reimbursement of travel and accommodation costs or for loss of earnings is excluded, except in cases of wilful misconduct or gross negligence on the part of the Institute’s legal representatives, employees or other vicarious agents.

§ 7 General Liability

The Institute’s liability for financial loss and damage to property is limited to cases of wilful misconduct and gross negligence, regardless of the legal basis.

No liability is accepted for accidents occurring during the event, on the way to and from the venue, or for theft, loss or damage to property, except in cases of wilful misconduct or gross negligence on the part of the Institute’s legal representatives, employees or other vicarious agents.

§ 8 Copyright

The Institute’s working documents and data carriers are protected by copyright and may not be reproduced or distributed, even in part, without the consent of the Institute and the speakers. The Institute and the speakers reserve all rights. The working documents are made available exclusively to participants of the respective event.

§ 9 Governing Law, Jurisdiction and Place of Performance

The contractual relationship is governed by German law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
The place of performance for the obligations of both parties and the place of jurisdiction is Halle (Saale).
